The legislation regulate payment of the community charges and the procedure to force property owners to pay. It is important for the community to take legal action as soon as possible, because it is only the debt of unpaid fees of the current year and the previous three years have the status of preferential.

The regulation of communities can be found in the law “Propiedad horizontal“ (Ley 49/1960, de 21 de julio). The law is updated by “Real Decretos” (the Government) or “Leyes” (the Parliament) that afterwards are incorporated in this law. The following text is based on the latest actualization of the law on 5 March 2019.

Procedure to claim the debt

When the debtor (property owner) opposes initial request for a payment (petición inicial del proceso monitorio), the creditor (community of property owners) can request the preventive seizure of sufficient assets from the latter, to meet the amount claimed, interest and costs.

The court will, in any case, agree to the preventive embargo without the need for the creditor (community of property owners) to provide security. However, the debtor may unburden the embargo by providing bank guarantee for the full amount.

Cuando el deudor se oponga a la petición inicial del proceso monitorio, el acreedor podrá solicitar el embargo preventivo de bienes suficientes de aquél, para hacer frente a la cantidad reclamada, los intereses y las costas.

 

El tribunal acordará, en todo caso, el embargo preventivo sin necesidad de que el acreedor preste caución. No obstante, el deudor podrá enervar el embargo prestando aval bancario por la cuantía por la que hubiese sido decretado.

The initial request for a payment procedure should be made in writing, which must include the following information:

  • The identity of the debtor (name and company name and DNI / NIF or CIF)
  • The domicile or domiciles of the creditor and the debtor or the place where they reside or could be found.
  • Briefly, the facts that have caused the debt.
  • The amount of the debt.

Together with the initial request, you must attach some of the documents in the section that states “How to prove the debt that is claimed”.

La petición inicial de procedimiento monitorio se hará mediante escrito en el que deberá constar necesariamente la siguiente información:

  • La identidad del deudor (nombre y apellidos o denominación social y DNI/ NIF o CIF)
  • El domicilio o domicilios del acreedor y del deudor o el lugar en que residieren o pudieran ser hallados.
  • De forma breve, los hechos que han originado la deuda.
  • La cuantía de la deuda.

Junto con la petición inicial deberá acompañar alguno/s de los documentos del apartado que señala “cómo acreditar la deuda que se reclama”.

How to prove the debt that is claimed

  1. By means of documents, whatever their form and class or the physical support they are in, that appear signed or stamped, imprinted or marked or with any other sign, physical or electronic, of the debtor.
  2. Through invoices, delivery notes, certifications, telegrams, telefax or any other documents that, even unilaterally created between the creditor and the debtor, are those that usually document the credits and monetary debts in relations of the class that appears to exist between the creditor and debtor.
  3. Through commercial documents that prove a long-lasting previous relationship and are provided together with the document in which the debt is recorded.

¿Cómo acreditar la deuda que se reclama?

  1. Mediante documentos, cualquiera que sea su forma y clase o el soporte físico en que se encuentren, que aparezcan firmados o con sello, impronta o marca o con cualquier otra señal, física o electrónica, de la persona deudora.
  2. Mediante facturas, albaranes de entrega, certificaciones, telegramas, telefax o cualesquiera otros documentos que, aun unilateralmente creados entre la persona acreedora y la deudora, sean de los que habitualmente documentan los créditos y deudas dinerarias en relaciones de la clase que aparezca existente entre la persona acreedora y deudora.
  3. Mediante documentos comerciales que acrediten una relación anterior duradera y se aporten junto al documento en que conste la deuda.

Owners' duty to pay community charges

The obligations referred to in sections e) and f) of article 9 must be fulfilled by the owner of the home or premises in the time and manner determined by the Board of property owners. Otherwise, the president or the administrator, if so agreed by the Board of property owners, may demand it legally by making a court claim of payment.

Las obligaciones a que se refieren los apartados e) y f) del artículo 9 deberán cumplirse por el propietario de la vivienda o local en el tiempo y forma determinados por la Junta. En caso contrario, el presidente o el administrador, si así lo acordase la junta de propietarios, podrá exigirlo judicialmente a través del proceso monitorio.

The obligations of each property owner:

e) Contribute, in accordance with the participation fee set out in the title or as specially established, to the general expenses for the adequate maintenance of the property, its services, charges and responsibilities that are not subject to individualization.

The credits in favour of the community derived from the obligation to contribute to the maintenance of the general expenses corresponding to the fees attributable to the overdue part of the current annuity and the previous three years have the status of preferential for the purposes of Article 1.923 of the Civil Law (Código Civil).

Son obligaciones de cada propietario:

e) Contribuir, con arreglo a la cuota de participación fijada en el título o a lo especialmente establecido, a los gastos generales para el adecuado sostenimiento del inmueble, sus servicios, cargas y responsabilidades que no sean susceptibles de individualización.

 

Los créditos a favor de la comunidad derivados de la obligación de contribuir al sostenimiento de los gastos generales correspondientes a las cuotas imputables a la parte vencida de la anualidad en curso y los tres años anteriores tienen la condición de preferentes a efectos del artículo 1.923 del Código Civil y preceden, para su satisfacción, a los citados en los números 3.º, 4.º y 5.º de dicho precepto, sin perjuicio de la preferencia establecida a favor de los créditos salariales en el texto refundido de la Ley del Estatuto de los Trabajadores, aprobado por el Real Decreto Legislativo 1/1995, de 24 de marzo.

The obligations of each property owner:

f) Contribute, according to their respective participation fee, to the provision of the reserve fund that will exist in the community of property owners to attend the conservation, repair and rehabilitation works of the estate, as well as the completion of the works of accessibility included in Article 10.1.b) of this Law.

Son obligaciones de cada propietario:

f) Contribuir, con arreglo a su respectiva cuota de participación, a la dotación del fondo de reserva que existirá en la comunidad de propietarios para atender las obras de conservación, de reparación y de rehabilitación de la finca, así como la realización de las obras de accesibilidad recogidas en el artículo Diez.1.b) de esta Ley.

The agenda will contain a list of the owners who are not up to date with the payment of debts to the community and will warn of the deprivation of the right to vote.

La convocatoria contendrá una relación de los propietarios que no estén al corriente en el pago de las deudas vencidas a la comunidad y advertirá de la privación del derecho de voto si se dan los supuestos previstos en el artículo 15.2.

Transfer of ownership

The purchaser of a home or premises in a horizontal property regime, even with title registered in the Property Registry (Registro de la Propiedad), is responsible for the amounts owed to the community of property owners (Comunidad propietarios) by the previous owners up to the limit of those fees that are attributable to the overdue part of the annuity in which the acquisition takes place and to the previous three calendar years. The apartment or premises will be legally subject to compliance with this duty.

But to register the new ownership in the Land Registry (Registro de la Propiedad) the seller must declare to be up-to-date with the payment of the fees to the community of property owners or express those owed. At this moment, the transferor must provide certification on the status of debts with the community coinciding with his statement, without which the granting of the public document cannot be authorized, unless expressly exempted from this obligation by the purchaser. The certification will be issued within a maximum period of seven calendar days from the request of the person exercising the functions of secretary, with the approval of the president, who will respond, in case of fault or negligence, of the accuracy of the data consigned in it and of the damages caused by the delay in its duty.

El adquirente de una vivienda o local en régimen de propiedad horizontal, incluso con título inscrito en el Registro de la Propiedad, responde con el propio inmueble adquirido de las cantidades adeudadas a la comunidad de propietarios para el sostenimiento de los gastos generales por los anteriores titulares hasta el límite de los que resulten imputables a la parte vencida de la anualidad en la cual tenga lugar la adquisición y a los tres años naturales anteriores. El piso o local estará legalmente afecto al cumplimiento de esta obligación.

 

En el instrumento público mediante el que se transmita, por cualquier título, la vivienda o local el transmitente, deberá declarar hallarse al corriente en el pago de los gastos generales de la comunidad de propietarios o expresar los que adeude. El transmitente deberá aportar en este momento certificación sobre el estado de deudas con la comunidad coincidente con su declaración, sin la cual no podrá autorizarse el otorgamiento del documento público, salvo que fuese expresamente exonerado de esta obligación por el adquirente. La certificación será emitida en el plazo máximo de siete días naturales desde su solicitud por quien ejerza las funciones de secretario, con el visto bueno del presidente, quienes responderán, en caso de culpa o negligencia, de la exactitud de los datos consignados en la misma y de los perjuicios causados por el retraso en su emisión.

The Administrator has to:

  1. To watch over the good keeping of the community, its facilities and services, and to make relevant warnings to the property owners.
  2. Prepare in due time and submit to the Board of property owners the plan of foreseeable expenses, proposing the necessary means to meet them.
  3. Attend to the maintenance of the community, arranging the repairs and measures that are urgent, immediately reporting them to the President or, where appropriate, to the property owners.
  4. To execute the agreements adopted in the matter of works and to make the payments and to carry out the collection of community fees.
  5. Act, as the case may be, as secretary of the Board of property owners and keep the documentation of the community to be available for the property owners.
  6. All other assigned powers by the Board of property owners.

The owner and the occupant of the apartment or premises are not allowed to develop in it or in the rest of the property activities prohibited in the statutes, that are harmful to the property or that contravene the general provisions on annoying, unhealthy, harmful, dangerous or illicit. The president of the community, on his own initiative or that of any of the owners or occupants, will require those who carry out the activities prohibited by this section to immediately cease them, under warning of initiating the appropriate legal actions. (Artículo 7.2, apartado 2, Ley 49/1960)
