Email from the Administration informing that they have not been able to have the Annual Community Meeting during year 2020, which does NOT correspond with reality

The Dossier of fiscal year 2019 was attached, including a letter from the Administrator dated 25 December 2020 (Christmas Day) where he writes that the annual community meeting, to approve the Fiscal Year of 2019, has not been possible to be held due to COVID-19.

The Administrator only refers to a regional law for Andalucía from 29 October 2020, as the reason why the annual community meeting (Junta general ordinaria) has not been held during the entire year 2020.

The community meeting should have been held soon after the fiscal year of 2019 had come towards an end, not almost a year afterwards.

The annual financial statements should be created soon after the accounting year has ended. If the accounting year ends by 31 December, then the financial statements should be created in January. The annual community meeting (Junta general ordinaria) should be held short thereafter.

The issue with COVID-19 was already commonly know in February 2020. We published a debate article on 3 March 2020 comparing COVID-19 with the pandemic called the “Spanish flue”.

The Call to the Annual Community Meeting (Junta general ordinaria) only has to be communicated to the property owners six days in advance, so it's possible to quickly arrange an Annual Community Meeting (Artículo 16.3, Ley 49/1960).

There were opportunities to held the Annual Community Meeting (Junta general ordinaria) before the State of emergency did not start until 14 March 2020.

Community meetings could also have been hold again in Andalucía when the State of emergency came towards an end on 21 June 2020.

The Association of Property Administrators of Malaga and Melilla (CAF – Málaga) recommended on 3 August 2020 that community meetings should be suspended due to increase of Covid-19, but this was just a recommendation.

It was first on 29 October 2020 when Community meetings of more then 6 people were prohibited in Andalucía.

There has obviously been plenty of opportunities to hold the Annual Community Meeting (Junta general ordinaria) during year 2020.

It is the President of the community that makes the calls to the community meetings (Artículo 16.2, Ley 49/1960).

It is a legal requirement to held an Annual Community Meeting (Junta general ordinaria) for approval of the previous Fiscal Year, election of Secretary, Administrator and the members of the Governing Board (Junta Directiva), etc. (Artículo 16.1, Ley 49/1960).
