The request made by the Regional Government of Junta de Andalucía to limit the access of nightlife venues only to those with valid EU COVID Certificates have been declined by the courts.
Junta de Andalucia has requested legal ratification of the measure issued in the Order of August 5, 2021 of the Ministry of Health and Families (“Consejería de Salud y Familias”), consisting of limited access to indoors of cocktail bars and nightclubs to those people who can prove that they are in possession of a valid EU COVID Digital Certificate.
The Chamber of the Superior Court of Justice of Andalusia (“Tribunal Superior de Justicia de Andalucía”) declined the request on 6 August (1543/2021).
Junta de Andalucia appealed against the decision of the Chamber of the Superior Court of Justice of Andalusia (“Tribunal Superior de Justicia de Andalucía”) to the Supreme Court (“Tribunal Supremo”) on 11 August.
Even the Supreme Court (“Tribunal Supremo”) declined on 18 August the request made by Junta de Andalucía (5899/2021).
The court did not find the measurements requested by Junta de Andalucía as suitable or proportionate for the achievement of the intended purpose.
